Court Rulings Reject Insurer Defenses to Biometric Liability – A Pasich Attorney & Tae Andrews Publish Claims Journal Article
A series of recent decisions have established that commonly held Commercial General Liability (CGL) policies cover lawsuits brought under Illinois’s Biometric Information Privacy Act (BIPA). Krishna Schaumburg Tan, Inc. which definitively established that CGL policies cover BIPA claims under their “personal and advertising injury” coverage, by holding that common policy exclusions do not apply.
In their Claims Journal article, a Pasich attorney and Senior Managing Associate Tae Andrews explain the importance of the new decisions as well as the growing importance of having insurance coverage in place for these types of lawsuits as more and more states enact legislation governing the capture, use, and disclosure of biometric information.
