While, at this juncture, many companies are trying to determine the extent of their losses, coronavirus insurance coverage litigation has already commenced and there is talk of government intervention at the federal level and in various states.
While many claims will involve business interruption coverage under property insurance policies, companies should look broadly at their other policies – including event cancellation, environmental, liability, and workers' compensation insurance – to assess coverage.
As for captives, and the breadth of potential coverage available, this crisis will give them an opportunity to demonstrate their value as part of a robust corporate risk management strategy.
