Peter Halprin Returns to the Chattinn Cyber Podcast to Discuss Statutory Privacy Liability and Insurance
Partner Peter Halprin joined the Chattinn Cyber podcast to discuss the role of insurance in statutory privacy claims, with a focus on Illinois’ Biometric Information Privacy Act (BIPA).
Peter explained that BIPA regulates, among other things, the collection, storage, consent, and destruction of biometric identifiers, including fingerprints and retinal scans. “BIPA also allows a private right to action, which means individuals or groups of individuals can sue companies directly for violations,” he said, pointing to the landmark Rosenbach v. Six Flags case.
When asked about BIPA insurance disputes, Peter said, “Most of these cases have involved general liability or business owners policies, and not cyber insurance, but insurance can play two critical roles. One, it can help with the defense of the claim and two, it can help with the indemnity or settlement.”
