Jacquelyn Mohr Discusses Deadline Limitations for Policyholders Filing COVID Coverage Lawsuits in Law360 Interview

Commercial policyholders dealing with the ongoing COVID pandemic are being forced to decide whether to move forward with filing coverage lawsuits due to deadline limitations. In an interview with Law360, Partner Jacquelyn Mohr said businesses will have to make decisions about filing without the benefit of clarity in the state law as that law is still very much in flux without any state high court rulings.

“With the pandemic still underway, many companies, particularly large businesses, are still working to quantify their losses,” Mohr commented. “Contractual limitations periods in insurance policies create artificial deadlines that may force insureds to bring suits earlier than would otherwise be the case.”

She advised policyholders to check the limitations periods in their policies and consider how statutory and contractual deadlines might apply to claims.
